WORKPLACE safety agency Comcare is prosecuting construction company John Holland in the Brisbane Federal Court over a 2008 death of a worker.
The 34-year-old man from Grasstree Beach was helping move a load of pre-cast concrete slabs at the Dalrymple Bay Coal Terminal when his foot became trapped under wooden scaffolding planks on the jetty.
He tripped and was run over and killed by the wheels of the trailer being used to carry the load.
The charges are that John Holland had breached the Occupational Health and Safety Act. The maximum civil penalty for such a breach is $242,000.
